General Terms and Conditions

§ 1 Scope

These General Terms and Conditions (GTC) apply to all contracts between Landmaschinenhandel Werner, proprietor Timo Werner, Weidig 5, 08258 Markneukirchen (hereinafter the "Seller"), and its customers for the purchase of machinery, vehicles, attachments and accessories.

§ 2 Conclusion of contract

The machines shown on this website are not a legally binding offer but an invitation to enquire, without obligation. A contract of sale only comes into effect once the Seller has expressly confirmed the order or has delivered the goods. The conditions agreed in each case shall apply.

§ 3 Prices

All prices include VAT at the statutory rate (19 %, shown separately on request), plus freight and delivery. We reserve the right to change prices and to sell in the meantime. The price agreed at the time of order confirmation shall apply.

§ 4 Delivery & transport

The goods are handed over assembled and ready for use. Delivery ex works 08258 Markneukirchen. Transport can be arranged on request; please give us your postcode so we can work out the delivery costs.

§ 5 Payment

Unless agreed otherwise, the purchase price is due on handover or before the goods are delivered. Individual finance and payment arrangements can be made by agreement.

§ 6 Retention of title

The goods remain the property of the Seller until paid for in full.

§ 7 Warranty

For consumers the warranty period is 2 years, for business customers 1 year from handover of the goods. In all other respects the statutory provisions apply.

§ 8 Liability

The Seller is liable without limitation for damage arising from injury to life, body or health, as well as in cases of intent and gross negligence. Otherwise liability is limited to the foreseeable damage typical of this type of contract. Any further liability is excluded.

§ 9 Right of withdrawal

For contracts concluded at a distance or away from business premises, consumers have a statutory right of withdrawal under the provisions of the German Civil Code (BGB). You will find the details, the consequences of withdrawal and the model withdrawal form in our withdrawal policy; we will also provide it to you before the contract is concluded. Business customers have no right of withdrawal.

§ 10 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

The law of the Federal Republic of Germany applies. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall not be affected.
